By placing an order with www.wmsc.co.uk and its brands Adesso, Capollini and Free Spirit, and continuing to browse, you are agreeing to comply and be bound by these terms and conditions. These do not affect your statutory rights. These terms and conditions may be updated from time to time by us but it is your responsibility to keep checking this page regularly to take notice of any changes we may have made.

      We will not be liable if for any reason this website is unavailable at any time for any period. From time to time, we may restrict access to some parts or all of this website. WMSC reserves the right to alter without prior notice any information within its website. The website also contains links to other websites, which are not operated by WMSC. WMSC has no control over these linked sites and accepts no responsibility for them or for any loss or damage that may arise from your use of them. Your use of the linked sites will be subject to the terms and conditions of each particular site.

          3. Prices and Payment

            All prices within the website are automatically generated in Pounds Sterling including VAT at the rate of 20% and are correct at the time of entering the information onto the system. However, you do have the option of changing the currency to Euros or US Dollars. The exchange rate is live and is calculated according to the conversion rate at that time. Whilst we try and ensure that all details, descriptions and prices which appear on this website are accurate, errors may occur. If we discover an error in the price of any goods you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If you chose to cancel the order you will receive a full refund. We reserve the right to alter information at any time without notice to you. Delivery is £3.95 to mainland United Kingdom and Northern Ireland or free when £20 or more is spent. Offshore and international delivery charges are additional. Please see our delivery page for full details. If you live outside of the EU then VAT will be deducted from your order at the checkout.

            Payment can be made by PayPal, Google Pay and most major credit or debit card except American Express. Payment will be debited and cleared from your account before the despatch of your goods or provision of the service to you. You confirm that the card or account that is to be used is yours. Upon receiving your order we carry out a standard pre-authorisation check on your payment card/account to ensure there are sufficient funds to fulfil the transaction. Goods will not be dispatched until this is complete and payment has been accepted. We may choose not to accept your order for any reason and will not be liable to you or to anyone else in those circumstances. 

              4. Product and Orders

                If an email has been provided, we will email you a confirmation by way of acknowledging your order within 24 hours. This email does not constitute acceptance of your order by us. All orders are subject to acceptance and availability. We always try to ensure that the website is up-to-date, however, if goods ordered are not available, you will be notified by email and you will be given an option for alternatives, to wait until the stock is available or to cancel. Any cancelled orders shall be fully refunded. The contract between WMSC and yourselves will commence once your payment has been debited from you. You agree that we will not be responsible for failing to deliver goods to you if you have supplied us with an incorrect address. Should you not receive your goods within 7 days please contact us here for further information.

                Please note that we do our best to accurately represent the items in our photography. However, as we have no control over the equipment you use to view the products (monitor colours, resolutions etc) we cannot guarantee colours will be exactly as they appear on the website.

                Any information regarding sizing of products is included as a guide only. If you are in any doubt as to the size of any product you require, we recommend that you contact us prior to placing an order.

                Please note that all boots are designed for comfort and durability. They are strictly fashion boots only and are not waterproof. The construction of all boots means that we cannot determine the waterproof properties of the products - unless expressly stated. Therefore we cannot accept any returns regarding this issue.

                5. Delivery

                We deliver to UK Mainland for £3.95 or is free when £20 or more is spent. Republic of Ireland and The Channel Islands will incur additional fees. We cannot deliver to PO Boxes and BFPO postcodes. For more information on deliveries and charges please visit our Delivery page at Delivery & Returns. We only despatch your order once payment has been authorised. Although we try to process and dispatch all orders the same day, this may not always be possible. You agree that we use independent third parties to deliver any products and therefore we cannot be held liable for any delays and/or loss caused by these delays. We aim to fulfil our delivery window of 2-3 days, however, due to circumstances out of our control this could take longer and delivery times are only an estimate. We deliver directly to the address specified in your order unless you state otherwise.  Once delivered, the items become your property and your responsibility therefore any loss or damage to goods passes on to you.

                If you order products for delivery outside of the United Kingdom, they may be subject to import duties and taxes, you will responsible for these. We have no control over these charges and cannot advise you what they may be. Please note that non-mainland destinations may incur additional charges.

                  6. Returns and Cancellations

                  All purchases are subject to the returns policy. You are entitled to cancel any contract or make a return within 14 days of delivery of the goods. You must notify us in writing to West Midland Shoe Company, Dovefields, Uttoxeter, Staffordshire, ST14 8HU or contact us here if you wish to cancel your order. If the payment has already been debited from your account, you will have to follow the returns procedure for a refund. We regret that we are unable to offer an exchange.You will be refunded for your orignial item(s) and you will need to place a new order for the replacement.

                  All returned items must be in its original unworn and unmarked condition with the original packaging. We ask that you do not tape, mark or write on the shoe boxes. On receipt of the goods, they will be inspected for the overall condition before making a refund. If we find that the product is not in a resalable condition we reserve the right to refuse a refund on that item. You must fill in the returns form including your order number otherwise we will not be able to process the refund. Please see our returns policy at Delivery & Returns for more information. We advise that you keep proof of postage for your return as a refund cannot be authorised if any items do not arrive back into our warehouse without this.

                  Please note we will only be able to refund items bought on this site. We cannot accept any products bought through other distribution channels. Proof of purchase is required in the form of either your order number or despatch note.

                  We will refund any monies within 30 days of receipt of your cancellation notice or upon return to our warehouse of the goods.

                  We will refund the purchase price for a product that is delivered in a damaged or faulty condition. You will need to contact us within 7 days after delivery. We reserve the right to refuse to issue a refund/replacement product if the product is found to have suffered damage after delivery or has been misused or used other than in accordance with the instructions or if the problem is due to normal wear and tear, wilful damage, negligence or abnormal usage conditions.                     We treat all your personal information as confidential whether this be through using the website or email. All details you provide when purchasing from the website are held on a secure server, and once we have received them, we will use strict procedures and security features to try and prevent any unauthorised access. We do not share any of these details with any 3rd parties except where it is part of providing a service to you- e.g arranging for a product to be sent to you, carrying out credit and other security checks and for the purposes of customer research and profiling or where we have your express permission to do so. Where we have given you (or where you have chosen) a password which enables you to access certain parts of the site, you are responsible for keeping this password confidential. Unfortunately, the transmission of information through the internet is not completely secure. Although we do our best to protect your personal data, we cannot guarantee the security to our site, any transmission is at your own risk.

                        9. Terms and Conditions of Competitions or Promotions

                          Social Media

                          Any prize draws promoted on our social media pages are open to UK mainland only. By participating you hereby release and hold harmless the social media platforms (such as Facebook, Twitter and Instagram) from any and all liability associated with the competition. Entrants are providing information to WMSC and not to these social media platforms. Any photos you may post to the Adesso, Capollini or Free Spirit Facebook pages, you are granting permission for these to be used by WMSC either on Social Media or our website. We can only accept 1 entry per person. Entries must be submitted by the closing date and time displayed in the details of the competition, we will not be responsible for any entries that are not received for any reason. The winner will be chosen at random or by a team of judges depending on the competition. If you win, you will be contacted via the relevant brand’s social media page or by email if one is provided. If we cannot contact you within 7 days from the closing date of the competition, we reserve the right to offer the prize to another competition entrant. No prize is exchangeable for cash or services. If an advertised prize is not available in your size for whatever reason we reserve the right to offer an alternative prize. If you enter a competition we will assume that you agree to these terms and conditions.

                          Terms and Conditions

                          1. Adesso Footwear, Capollini Footwear or Free Spirit Footwear of The West Midland Shoe Company, Dovefields, Uttoxeter will not be liable for, and accepts no responsibility for any votes that are delayed or not received for whatever reason. No votes shall be counted nor considered after the competition has closed.
                          2. The winner of the competition will be selected at random. These will need to be claimed within 7 days of the closing date. Entrants must be aged 18 or over and are mainland UK residents.
                          3. By participating and/or answering on our Social Media pages and therefore entering the competition constitutes acceptance of these Terms and Conditions.
                          4. The winner will be notified on the relevant social media platform within a maximum of 7 days after the competition has closed. The notification will include details on how to claim the prize. This competition is not sponsored, endorsed or administered by the social media platform, nor are they associated with the competition in any way. Any questions, comments or complaints regarding this competition must be directed to WMSC and not to the social media platform directly. WMSC reserve the right to feature photographs, names and locations of any competition winners in the future.
                          5. There is no cash alternative to the stated prize and those shoes chosen cannot be exchanged unless faulty. WMSC shall be under no liability in respect of any defect arising from wear and tear, willful damage, negligence, abnormal usage conditions or failure to follow instructions.
                          6. This prize must be won. If no contact can be made with the winner within 7 days from the closing date, a second winner shall be chosen at random and the original deemed void.
                          7. WMSC will not be liable to any entrant if a competition cannot go ahead, is delayed or has to be cancelled due to any legal issues, system failure or any other causes beyond their control. WMSC reserve the right to change these Terms and Conditions at any time without prior notice.
